By accessing or using the ByteStack website and services, you agree to be bound by these Terms of Service. If you do not agree to these terms, you should not use our services. These terms apply to all visitors, users, and clients of ByteStack.

ByteStack provides competition and raffle management software, including a full platform for competition businesses and a plugin for existing websites. Our services include competition creation tools, ticketing systems, payment processing integration, draw management, CRM, marketing tools, and compliance features.

3. User Responsibilities

As a user of ByteStack, you are responsible for:

  • Ensuring your competitions comply with all applicable UK laws and regulations
  • Providing accurate and truthful information about prizes and competition terms
  • Maintaining the security of your account credentials
  • Obtaining appropriate legal advice for your specific competition activities
  • Ensuring all marketing materials are accurate and not misleading

4. Compliance Disclaimer

While ByteStack provides tools designed to support compliance with UK prize competition regulations, including alignment with the DCMS voluntary code of good practice, our platform does not constitute legal advice. Users are responsible for ensuring their activities comply with all applicable laws and should seek independent legal counsel where appropriate.

5. Payment Terms

Fees for ByteStack services are as agreed in your service agreement. Payment terms, billing cycles, and refund policies are outlined in your individual contract. We reserve the right to modify pricing with reasonable notice.

6. Intellectual Property

The ByteStack platform, including all software, designs, content, and documentation, is the intellectual property of ByteStack. You may not copy, modify, distribute, or reverse-engineer any part of our platform without written permission.

7. Limitation of Liability

ByteStack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our services. Our total liability is limited to the amount paid by you for the services in the twelve months preceding the claim.

8. Termination

Either party may terminate the service agreement in accordance with the terms of their individual contract. Upon termination, you will retain access to export your data for a reasonable period as specified in your agreement.

9. Governing Law

These terms are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.
